Strong migratory pressure towards rich countries receives firm resistance from states of destination. These movements of population may originate from generalized situations of violence (civil war, systematic oppression from authoritarian regimes), from individual persecution or from economic disarray. Since legal immigration procedures remain narrow and difficult, or prove unsuitable, a great many migrants find illegal alternatives. Parallel societies of precarious clandestine existences are growing in countries of destination. Moreover, the issue of clandestine immigration bears a negative connection to criminal activities that profit by illegally moving persons: those in the business of transport, and also traffickers of human beings. The Special Focus here is on the rights of the "clandestine man": where do fundamental rights (prohibition of torture, freedom of movement, right to family life, right to liberty and security, principle of equality...) fit into these circumstances?

In its decision Boultif, the ECHR seems to consider that the wedding of a foreigner constitutes an obstacle to her/his deportation. The author advocates that any kind of private or affective life should be more clearly protected, whatever its status.
